Terms of Service

1. Acceptance of Terms

By accessing or using mlr. (the "Service"), operated by Mohammed Azirar, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

mlr. is an email campaign management platform that allows users to manage recipient lists, affiliate offers, MTA servers, and email campaigns. The Service is provided at app.getmlr.com.

3. Account Terms

  • You must be at least 16 years old to use the Service.
  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • One person or entity per account. Sharing account credentials is not permitted.
  • You must promptly notify us if you become aware of any unauthorized use of your account.

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the Acceptable Use Policy may result in immediate suspension or termination of your account.

5. Payment Terms

  • The Service offers free and paid plans. Paid plan features and pricing are described on our pricing page.
  • Payments are processed securely through Stripe. By subscribing to a paid plan, you agree to Stripe's terms of service.
  • Paid subscriptions are billed monthly and renew automatically unless cancelled.
  • You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods. If you cancel mid-cycle, you retain access to paid features until the end of your current period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honoured at their current rate until the next renewal.
  • If payment fails, your account may be downgraded to the free plan after a grace period.

6. Service Availability

We strive to provide reliable service but do not guarantee any specific uptime or availability. The Service is provided on an "as is" and "as available" basis. We may perform maintenance or updates that result in temporary downtime.

7. Your Data

  • You retain all rights to the data you upload to the Service (recipient lists, email creatives, etc.).
  • You are solely responsible for the legality and accuracy of the data you upload and the emails you send.
  • You grant us a limited license to process your data solely for the purpose of providing the Service.
  • Our handling of personal data is governed by our Privacy Policy and Data Processing Agreement.

8. Intellectual Property

The Service, including its design, code, documentation, and branding, is the intellectual property of Mohammed Azirar. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not liable for any damages resulting from emails you send using the Service, including delivery failures, spam complaints, or blocklisting.

10. Indemnification

You agree to indemnify and hold harmless Mohammed Azirar and mlr. from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws.

11. Termination

  • You may cancel your account at any time by contacting us at support@getmlr.com.
  • We may suspend or terminate your account immediately if you violate these Terms or the Acceptable Use Policy.
  • Upon termination, your data will be deleted within 30 days, unless we are required to retain it by law.
  • Sections on limitation of liability, indemnification, and governing law survive termination.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the email address associated with your account or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands.
